Diversified Mortgage Company, Inc., et al.

TO:  any stockholders, creditors and any other persons claiming any interest in Diversified Mortgage Company, Inc., a dissolved Rhode Island corporation, formerly located in Warwick in the state of Rhode Island, their heirs, devisees, legal representatives, successors or assigns.

    You are hereby notified that a complaint has been filed by the above named plaintiffs in which you are named as an interested party.  This complaint concerns a certain parcel of land in Springfield, Hampden County, and said Commonwealth being known as and numbered 341 St. James Avenue, title to said parcel is clouded by a mortgage given by Icie B. Jones to Diversified Mortgage Company, Inc., said mortgage being dated March 31, 1998, and recorded with the Hampden County Registry of Deeds in Book 10224, Page 395, plaintiffs allege that all obligations secured by the aforementioned mortgage have been performed and that he is entitled to discharges to clear the record and seeks a judgment to that effect. 

    This complaint may be examined at the Land Court, Boston, Massachusetts, or a copy obtained from plaintiff’s attorney.

    If you intend to make any defense, you are hereby required to serve upon the plaintiff’s attorney, Denise A. Chicoine, Esq., Englander & Chicoine P.C. whose address is 44 School Street, Suite 800, Boston, MA 02108 an answer to the complaint on or before the twentieth day of April, next, the return day, hereof, and a copy thereof must be filed in this court on or before said day.

    If you fail to do so, judgment by default will be taken against you for the relief demanded in the complaint.  Unless otherwise provided by Rule 13(a), your answer must state as a counterclaim any claim which you may have against the plaintiff which arise out of the transaction or occurrence that is the subject matter of the plaintiff’s claim or you will thereafter be barred from making such claim in any other action.

    It is ORDERED that notice be given by publishing a copy of this notice once in The Warwick Beacon, a newspaper published in Warwick, Rhode Island at least thirty days before the twentieth day of April.
